FENCE RULES – NEW IBERIA (CITY), LOUISIANA

GOVERNANCE

The City of New Iberia regulates residential fences through Appendix A, Zoning, including Sec. 3.1601, Sec. 3.1603, Sec. 3.1604, and related visibility provisions.

The New Iberia Permit & Inspection Department administers fence permitting and plan approval. The Planning & Zoning Department is the city office identified for zoning and planning matters.

The city does not publish a single stand-alone residential fence chapter in the materials reviewed for this page. Instead, fence rules are spread across supplementary district regulations, fence and wall standards, visibility rules, and permit materials.

PERMIT AND APPROVAL REQUIREMENTS

Building Permit: The New Iberia Permit & Inspection Department states that a building permit is required for installing a fence within the City of New Iberia. The city’s fence and deck permit sheet states that a fence permit is issued after a complete set of plans is approved by the department.

Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Planning & Zoning Department before construction.

FENCE PLACEMENT RULES

Lot Boundaries: Sec. 3.1601(2) states that fences may be erected along the boundaries of a lot or yard area, subject to the requirements of the building code. One segment of a fence may be erected in a required side yard.

Property Lines: The ordinance does not publish a separate setback distance for standard residential fences from property lines. It does require property lines to be located so that no fence, hedge, or wall extends beyond or across a property line unless an agreement with the abutting property owner is obtained.

Easements: The city’s fence and deck permit sheet states that fence permits must comply with easement requirements.

Corner and Driveway Areas: Where a driveway intersects a public right-of-way, or where property abuts the intersection of two public rights-of-way, fences within the corner triangle area must preserve unobstructed cross-visibility.

Utility Safety: Louisiana’s Underground Utilities and Facilities Damage Prevention Law requires the person responsible for excavation or demolition to provide notice to the regional notification center (Louisiana 811) before digging. Notice must be provided at least two (2) full business days before the proposed commencement date of the excavation or demolition. Markings are considered valid up to 20 calendar days from the “mark-by” time, as long as the marks remain visible.

FENCE HEIGHT AND VISIBILITY RULES

Maximum Height: No fence or wall may exceed eight feet in height, measured vertically from adjacent ground grade.

Front and Side Yard Height: In the front yard and in the side yard from the building setback line to the front line, a fence, hedge, or wall may not exceed four feet in height unless the material permits 75 percent unobstructed view when viewed at a 90-degree angle from the direction of the fence, hedge, or wall. The adequate view angle is determined by the chief building inspector.

Corner Lot Triangle: On a corner lot in any district, no fence, wall, hedge, structure, or planting more than three feet in height may be erected, placed, or maintained within the triangular area formed by the intersecting street lines and a straight line joining points 30 feet from the intersection.

Street Intersection Visibility: Any fence, hedge, or wall placed within 15 feet of the intersection of a public street may not restrict or obscure visibility through that fence, hedge, or wall by more than 25 percent of its total vertical plane area.

MATERIAL AND CONSTRUCTION LIMITS

Prohibited Fence Types: No barbed wire or other sharp, pointed, or electrically charged fence may be erected or maintained except for the stated ordinance exceptions.

Construction Site Exception: A temporary fence on a construction site may include barbed wire if the barbed wire is placed at least six feet above grade.

Internal Fence Exception: A barbed wire fence or electrically charged fence may be used as an internal fence, not on the periphery of the property.

Periphery Exception: Barbed wire may be used on the periphery of the property only when placed six feet above grade.

Material Standard: Fence material must be of a durable nature, pleasant in appearance, acceptable to the building official, and maintained in good condition. The code does not publish a list of approved residential fence materials beyond these general standards.

PRIVATE RESTRICTIONS

Homeowners association rules, subdivision covenants, deed restrictions, and similar private agreements operate independently of city regulations and may be more restrictive than the City of New Iberia code.
