FENCE RULES – LAFOURCHE (PARISH), LOUISIANA

OVERVIEW

Residential fences are permitted on private property within Lafourche Parish, subject to local regulations.

Residential fence rules in Lafourche Parish are not collected in a single standalone fence chapter. GOVERNANCE

Residential fence administration in Lafourche Parish is split among the Lafourche Parish Council, the parish Permits & Planning Department, the Planning Department, and the Lafourche Parish Department of Public Works for fence permit intake and inspection.

The principal residential fence rules are not organized as a consolidated parish fence code. Instead, they appear primarily in Chapter 10, Buildings and Building Regulations, including the fence fee and traffic-visibility language, in the drainage-servitude language of Chapter 36, and in the parish’s posted Fence Permit Application and Fence Permit Requirements FAQ’s.

The Planning Department states that land development activity in the unincorporated areas is reviewed through planning processes, but that the unincorporated areas of Lafourche Parish have no zoning regulations.

PERMIT AND APPROVAL REQUIREMENTS

Fence Permit Trigger: A fence permit must be submitted to the Lafourche Parish Department of Public Works when a new fence is being constructed or when more than 50 percent of the length of an existing fence on the property is being replaced or repaired.

Minor Repairs: Simple repairs such as replacement of individual pickets, replacement of posts, or painting or staining a fence do not require a permit.

Site Plan: A site plan is required. The parish’s published FAQ states that site plan review approval is required for permitting of fences, walls, or other barriers.

Over-8-Foot Fences: Fences over 8 feet in height must comply with building-code requirements. Applications for fences over 8 feet must provide 2 complete sets of plans bearing the live stamp or seal of the design professional. For fences of an open design, the Code Official may waive stamped or sealed plans.

Permit Duration: The published fence permit states that the permit expires 1 year from the issue date.

Zoning: The Planning Department states that the unincorporated areas of Lafourche Parish have no zoning regulations.

FENCE PLACEMENT RULES

Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements or servitudes.

Public Right-of-Way: Fences must be built on private property and not on public rights-of-way.

Servitudes and Rights-of-Way: The parish’s fence checklist states that construction of a fence within or crossing a servitude or right-of-way is at the owner’s risk, and the owner is responsible for moving the fence if access is needed. The parish drainage ordinance also states that no fence or other improvement may be constructed within or over a servitude or right-of-way so as to prevent or unreasonably interfere with the purposes for which that servitude or right-of-way was granted.

Property Line Identification: When a fence is proposed on a property line, the property owner is responsible for identifying that line. A property survey may be required at the owner’s expense.

Drainage: No fence may prevent the proper drainage of any lot. If the Lafourche Parish Public Works Director determines that a proposed fence or appurtenant structure would be detrimental to drainage, the permit may not be issued.

Utility Safety: Louisiana’s Underground Utilities and Facilities Damage Prevention Law requires the person responsible for excavation or demolition to provide notice to the regional notification center (Louisiana 811) before digging. Notice must be provided at least two (2) full business days before the proposed commencement date of the excavation or demolition. Markings are considered valid up to 20 calendar days from the “mark-by” time, as long as the marks remain visible.

FENCE HEIGHT AND VISIBILITY RULES

Published Height Standard: The parish’s published fence FAQ states 8 feet tall.

Fences Above 8 Feet: In side and rear yards, fences over 8 feet are regulated under building-code requirements. The published fence materials do not state a separate parishwide absolute maximum height beyond those additional requirements.

Traffic Visibility: No fence may be constructed in a manner that prevents a driver of a vehicle from having a clear, unobstructed view of traffic signs and approaching, merging, or intersecting traffic.

Front Building Line Taper: Fences built past the front building line must taper down to a maximum of 3 feet.

Corner Lots: Buildings on corners are treated as having 2 front building lines, so the 3-foot taper applies on both sides of the corner.

MATERIAL AND CONSTRUCTION LIMITS

Recognized Fence Materials: The parish’s published fence materials identify wood, vinyl or solid plastic, chain link or other metal, masonry or brick, wrought iron, open wire or rail, and similar fence materials as standard fence types.

Structural Soundness: Fences must be structurally sound and durable. Fences deemed structurally unsound are subject to removal if deemed unsafe or a public hazard.

Fragile or Flammable Materials: Paper, cloth, reeds, canes, or canvas may not constitute any part of a fence, and those materials may not be used as an adjunct, attachment, or supplement to a fence.

Hazardous Materials: Except on tracts used as pasture, farming, or agriculture, barbed wire or other materials deemed hazardous by the Lafourche Parish Public Works Department may not be placed on a fence less than 7 feet above the ground or grade.

Fences Above 8 Feet: Fences over 8 feet must be of noncombustible material.

PRIVATE RESTRICTIONS

Homeowners association covenants, subdivision restrictions, and other private agreements operate independently of Lafourche Parish regulations and may be more restrictive than the parish’s published fence standards.

REVIEW AND ENFORCEMENT CONTEXT

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:

Permit Review: Construction of a new fence, or replacement or repair of more than 50 percent of an existing fence length, without the required fence permit, site plan, or final inspection.

Height Review: Proposals for fences over 8 feet without the required noncombustible materials or required stamped plan submittals.

Visibility Hazards: Fence construction that obstructs traffic signs or approaching, merging, or intersecting traffic, or that fails to taper to 3 feet where the fence extends past the front building line, including on corner lots.

Drainage Conflicts: Fence construction that prevents proper lot drainage or that the parish determines would be detrimental to drainage.

Right-of-Way or Servitude Encroachment: Fence placement on a public right-of-way, or within a servitude or right-of-way in a manner that interferes with access, drainage, utilities, or other granted public purposes.

Unsafe Fence Conditions: Fences deemed structurally unsound, unsafe, or a public hazard.
