FENCE RULES – EVANGELINE (PARISH), LOUISIANA

OVERVIEW

Residential fences are permitted on private property within Evangeline Parish, subject to local regulations. Evangeline Parish does not publish a standalone residential fence article. Related rules appear primarily in Chapter 8, Buildings and Construction, with additional location-based constraints in the floodplain provisions and scattered right-of-way, drainage, and nuisance provisions.

This page applies to properties in the unincorporated areas of Evangeline Parish; incorporated municipalities regulate fences under their own ordinances.

This page focuses on typical single-family residential fencing. If the jurisdiction’s adopted materials do not state a specific limit or requirement, this page notes that the code does not specify one.

The published materials establish a broad permit framework for construction in the unincorporated parish, but they do not publish a fence-specific permit exemption, height table, or materials list for standard residential fencing.

Compiled From the Code of Ordinances of the Parish of Evangeline and the Evangeline Parish Police Jury Departments page as of March 2026.

GOVERNANCE

The governing authority is the Evangeline Parish Police Jury. Under Chapter 8, the buildings chapter is administered by the parish engineer or a duly appointed representative. Chapter 26 creates the Evangeline Parish Planning Commission.

Evangeline Parish does not publish a consolidated fence code. Fence-related administration must be drawn from the general permit provisions in Chapter 8, Buildings and Construction, the location-based restrictions in Article II, Flood Damage Prevention, and related provisions in the parish’s planning, subdivision, right-of-way, drainage, and nuisance rules. The parish departments page identifies the Secretary/Treasurer / Permit Secretary within the permit process.

PERMIT AND APPROVAL REQUIREMENTS

Building Permit Framework: The parish code requires a permit before beginning a construction project or locating a structure in the unincorporated parish. The official parish materials do not publish a fence-specific building permit exemption for standard residential fences.

Limited Published Exemption: The only express exemption published in Section 8-4 is for additions or alteration projects valued at $5,000.00 or less that do not require additional square footage. The code does not state that this exemption applies to fences.

Floodplain Development Permit: In areas of special flood hazard, a floodplain development permit is required.

Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Evangeline Parish Planning Commission before construction.

FENCE PLACEMENT RULES

Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements or servitudes.

Floodplain and Floodway Areas: In areas of special flood hazard, development permit requirements apply. In designated regulatory floodways, encroachments are prohibited unless the required analysis shows no increase in flood levels.

Drainage and Servitudes: The parish’s published materials recognize easements and servitudes for utilities, drainage, and other public purposes. Where a parish drainage project requires a right-of-way agreement, the agreement must hold the parish harmless for fence removal and replacement, and fences affected by the project remain the property owner’s responsibility.

Other Published Location Rules: The parish code does not specify gate swing, corner-lot fence placement, or other standard residential fence location rules.

Utility Safety: Louisiana’s Underground Utilities and Facilities Damage Prevention Law requires the person responsible for excavation or demolition to provide notice to the regional notification center (Louisiana 811) before digging. Notice must be provided at least two (2) full business days before the proposed commencement date of the excavation or demolition. Markings are considered valid up to 20 calendar days from the “mark-by” time, as long as the marks remain visible.

FENCE HEIGHT AND VISIBILITY RULES

Maximum Height: The parish code does not specify a maximum height for standard residential fences.

Yard-Based Height Limits: The parish code does not specify separate front-yard, side-yard, or rear-yard fence height limits.

Visibility: The parish code does not specify a residential sight-triangle or fence visibility-clearance rule.

MATERIAL AND CONSTRUCTION LIMITS

Materials: The parish code does not specify permitted or prohibited materials for standard residential fences.

Construction Standards: The parish code does not publish fence-specific standards for opacity, finished side orientation, or similar residential fence construction details.

PRIVATE RESTRICTIONS

Private covenants, deed restrictions, and homeowners’ association rules operate independently of parish regulations and may be more restrictive. Where parish rules and private restrictions overlap, the more stringent restriction controls if both apply to the same site condition.

REVIEW AND ENFORCEMENT CONTEXT

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:

Permit Review: Review can occur when a fence is treated as part of a construction project or structure subject to the parish permit framework.

Floodplain Review: Review can occur in areas of special flood hazard, where a floodplain development permit is required, and in designated floodways, where encroachments are restricted.

Drainage, Right-of-Way, and Servitude Conflicts: Review can occur where a fence conflicts with parish drainage work, public rights-of-way, easements, or servitudes.

Nuisance Complaints: Complaint-based enforcement can occur where a fence or related site condition is treated as a nuisance, unsafe condition, or other violation of parish ordinances.

Permit Office Enforcement: The permitting office may issue written notices and may terminate permit tags or order utility disconnection when parish ordinance violations are not corrected.
